Terms of Service

Please read these Terms of Service ("Terms") carefully. They form a binding legal agreement between you ("you" or "User") and Animal Aftercare("Animal Aftercare," "we," or "us") regarding your use of our website and services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Animal Aftercare website and its services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use our Service. By using this Service, you represent that you are at least 18 years of age.

2. Description of Service

Animal Aftercareoperates as a lead-generation platform that connects families seeking end-of-life pet care ("Users") with pre-vetted, licensed local providers ("Providers") offering services such as pet euthanasia, pet cremation, and equine cremation. We facilitate the introduction, but we do not directly perform these services, nor are we responsible for the services ultimately provided by our Providers.

3. User and Provider Accounts

  • For Users (Families): By submitting a request, you agree to provide accurate and complete information. You understand that your contact details and request will be shared with our Providers to facilitate next steps.
  • For Providers: By signing up as a Provider, you agree to provide accurate business and contact information, and you represent that you (and any veterinarians on your staff, for euthanasia services) hold all required state and local licenses. You are responsible for maintaining the confidentiality of your account access and for all activities that occur under your account.

3.1 User Content License

By submitting photos or other content through our Service, you grant Animal Aftercare and our Providers a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content solely for the purpose of facilitating aftercare services. This license terminates when your content is deleted from our systems (within 30 days of submission).

4. Payments (For Providers)

Providers operate on a per-lead payment model.

  • Per-Lead Payments: For un-redacted lead details, Providers pay a per-lead fee. Payment processing is handled by Stripe.

4.1 Lead Distribution and Competition

For Per-Lead Providers:You may receive notifications about leads that are simultaneously offered to other per-lead providers. Leads are offered on a first-purchase basis — the first provider to complete payment receives exclusive access to the lead’s full contact details. If another provider purchases a lead before you complete checkout, your payment will be refunded in full within 5 business days.

All payments are non-refundable once processed, except as outlined in our Refund Policy, which is incorporated into these Terms by reference.

5. User and Provider Conduct

You agree not to use the Service to:

  • Provide false, misleading, or inaccurate information in any form or submission.
  • Engage in any activity that is illegal, fraudulent, or harmful to others.
  • Attempt to gain unauthorized access to our systems or other users’ data.
  • Use the Service for any purpose other than its intended use.
  • Disrupt or interfere with the security or integrity of the Service.
  • Infringe upon the intellectual property rights of Animal Aftercare or others.

We reserve the right to suspend or terminate access to the Service for any violation of these guidelines. Providers found to have practiced without required licensing may be removed from the network immediately.

6. Intellectual Property

All content, features, and functionality on the Service — including text, graphics, logos, and software — are the exclusive property of Animal Aftercare or its licensors and are protected by copyright, trademark, and other intellectual property laws.

7. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Animal Aftercare does not guarantee the availability, quality, or performance of any services offered by Providers. We are not responsible for any disputes between Users and Providers.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANIMAL AFTERCARE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, USA, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including if you breach the Terms.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect.
